By accessing and using BetterSense.ai's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

2. Service Description

BetterSense.ai provides a pricing compliance platform that offers real-time price monitoring across multiple e-commerce marketplaces to detect MAP (Minimum Advertised Price) violations. Our service analyzes publicly available pricing data and is provided "as is" without warranties of any kind.

3. User Responsibilities

As a user of our service, you agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the confidentiality of your account credentials
  • Comply with all applicable laws and regulations
  • Report any unauthorized access to your account immediately
  • Use the service only for lawful purposes related to MAP compliance monitoring

4. Limitation of Liability

To the maximum extent permitted by law, BetterSense.ai's liability is limited to the amounts paid by you in the twelve (12) months preceding the event giving rise to liability.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.

5. Warranty Disclaimers

The service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • That the service will be uninterrupted or error-free
  • That defects will be corrected
  • That the service is free from viruses or other harmful components

6. Indemnification

You agree to indemnify, defend, and hold harmless BetterSense.ai and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the service or violation of these terms.

7. Payment & Refund Policy

No-Refund Policy

All payments made to BetterSense.ai are final and non-refundable. By subscribing to our service, you acknowledge and agree to this no-refund policy.

Cancellation Process

To cancel your account:

  • Send an email to [email protected] with the subject line "Close Account"
  • Account closure will be processed within 5-7 business days
  • You will retain access to the service through the end of your current billing period

Service Credits

While we do not offer refunds, we may provide discretionary service credits in the following circumstances:

  • Extended service downtime (24+ consecutive hours)
  • Critical service failures affecting core functionality
  • Credits are valid for 12 months from the date of issue
  • Credits cannot be transferred or redeemed for cash

8. Data & Privacy

We collect and analyze publicly available marketplace pricing data to provide our services. Your user-specific compliance information and data are protected and will not be shared with competitors.

9. Intellectual Property

All content, features, and functionality of the BetterSense.ai platform, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software, are the exclusive property of BetterSense.ai and are protected by copyright, trademark, and other intellectual property laws.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts in Chandigarh, India.

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to users with 30 days' notice. Your continued use of the service after such modifications constitutes acceptance of the updated terms.

12. Termination Rights

We reserve the right to suspend or terminate your account and access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.
